By using Puncta, you agree to these Terms & Conditions, designed in accordance with Swedish law, EU regulations, and consumer rights. If you do not agree, please discontinue use of the platform.

1. Definitions
“Platform” refers to Puncta, operated under Swedish law.
“Host” refers to individuals or businesses offering experiences.
“Customer” refers to users booking experiences.
“Experience” refers to the service or activity booked through Puncta.
“Service Fees” refer to (i) a 15% host commission deducted from each booking payout to the Host, and (ii) a 5% customer service fee shown at checkout. In accordance with Swedish law, Swedish VAT (25%) applies only to Puncta’s service fees; VAT on the Host’s own services (if any) is the Host’s responsibility.
2. Eligibility of Users
Hosts must be at least 18 years old and legally eligible to provide services under Swedish law. Customers must also be 18 years old or have parental consent to make bookings. By using the platform, all users confirm they have full legal capacity.
3. Account Registration
Users must register with accurate personal information, including full name, phone number, email, and other required details. Misrepresentation of identity may result in account suspension or legal action under Swedish law.
Puncta may conduct identity, KYC/AML, and fraud-prevention checks and may request additional documentation before enabling listings, bookings, or payouts.
4. Booking & Payment
Payments are processed securely via Puncta’s payment provider. Puncta acts as an intermediary platform: the Customer pays the booking amount, and Puncta settles payouts to the Host according to these Terms. A 5% customer service fee is displayed at checkout and included in the customer’s total payment.
By confirming a booking, Customers consent to share necessary details (name, email, phone) with the Host. Host details are shared with the Customer only after a confirmed booking. Payment processor fees, where applicable, are disclosed at checkout and reflected in payout statements.
5. Commission & Host Payouts
Puncta charges a 15% host commission on each booking, deducted from the Host’s payout. Puncta also charges a 5% customer service fee, shown at checkout and paid by the Customer. Under Swedish law, 25% VAT applies only to Puncta’s service fees (host commission and customer service fee). VAT related to Puncta’s service fees is handled by Puncta and is not additionally deducted from the Host’s payout.
Example (1,000 SEK booking): Host commission 150 SEK; customer service fee 50 SEK (displayed at checkout). Net payout to Host = 850 SEK. VAT (25%) on Puncta’s service fees is accounted for by Puncta in accordance with law.
Payouts are made to Hosts 7 days after the experience has been completed (not the booking date), minus the 15% host commission. Puncta may delay or withhold payouts where required by law, suspected fraud, unresolved disputes, chargebacks, or failure to complete KYC.
In certain B2B cross-border EU cases with a valid VAT number and where legally applicable, reverse-charge rules may apply to Puncta’s invoicing of service fees. Hosts remain solely responsible for reporting and paying taxes applicable to their own services and income.
6. Cancellations & Refunds
Cancellation and refund terms are defined by the Host’s published policy on each listing (e.g., Flexible, Moderate, Strict) and shown at checkout. Refunds are processed to the original payment method according to the applicable policy and Swedish consumer protection rules.
If a Host cancels, the Customer is entitled to a full refund. No-shows are generally non-refundable unless specified in the Host’s policy or required by law.
7. Consent & Data Sharing
By using the platform, both Hosts and Customers consent to sharing necessary personal information with one another for the purpose of completing a booking. This may include name, phone number, email, profile picture, and location related to the experience. Data is shared only after payment confirmation and in accordance with GDPR.
8. Privacy & GDPR
Puncta complies with the General Data Protection Regulation (GDPR) and Swedish data protection laws. Users may request access to, correction of, or deletion of their data at any time by contacting support. Personal data will not be sold to third parties.

9. Host Responsibilities
- Ensure experiences are safe, legal, and accurately described.
- Obtain and maintain all necessary permits, licenses, insurance, and approvals required for activities.
- Ensure customer safety during the experience and communicate relevant risks and requirements.
- Set prices that include any taxes or charges applicable to the Host’s services and comply with tax obligations.
10. Customer Responsibilities
- Provide accurate information during booking and meet experience requirements.
- Behave respectfully, follow safety instructions, and avoid illegal or unsafe behavior during the experience.
- Review and respect the Host’s cancellation and house rules as shown at checkout.
11. Customer Rights (Konsumenträttigheter)
Customers in Sweden are protected under consumer law, including rights to clear pricing and terms, refunds according to the applicable cancellation policy, compensation for defective or misleading services, and protection against unfair contract terms. These rights cannot be waived by agreement.
Note: Under Swedish and EU law, the statutory right of withdrawal (ångerrätt) does not generally apply to leisure services for a specific date or period.
12. Liability & Disclaimer
Puncta acts solely as an intermediary platform and is not the provider of the Experiences. Puncta is not liable for injuries, losses, or damages arising from an Experience. Responsibility lies with the Host. Customers participate at their own risk unless otherwise covered by insurance.
Force majeure: Puncta is not responsible for delays or failures caused by events beyond its reasonable control (e.g., natural disasters, strikes, outages, legal restrictions, payment network failures).
13. Intellectual Property
All content, branding, logos, and website materials are the property of Puncta and protected by copyright law. Users may not copy, distribute, or modify without written consent.
14. Termination of Accounts
Puncta reserves the right to suspend or terminate accounts in cases of fraud, illegal activity, repeated violations, chargebacks, or violation of these Terms & Conditions. Puncta may withhold payouts as permitted by law to cover refunds, penalties, or unpaid amounts.
15. Changes to Terms
Puncta may update these Terms & Conditions at any time to reflect changes in the law, business practices, or customer needs. Users will be notified in advance of significant changes. Continued use of the platform after changes take effect constitutes acceptance.
16. Governing Law & Dispute Resolution
These Terms & Conditions are governed by Swedish law. Users should first contact Puncta support to seek an amicable resolution. Disputes may be brought before Swedish courts. Customers may also contact Konsumentverket, the National Board for Consumer Disputes (ARN), or use the EU Online Dispute Resolution (ODR) platform.
